## Short answer

Yes — California agents can use AI for listing copy, photos and marketing. The DRE regulates what is published: accurate ads, brokerage identification, fair housing compliance and disclosure of altered photos.

## California advertising rules

- First-point-of-contact marketing, including listing pages and social posts, must show the licensee's name and DRE license number.
- California requires a clear disclosure when a real estate advertisement uses a digitally altered image — which includes AI virtual staging and object removal. The unaltered image must also be available to view.
- False or misleading advertising can lead to discipline against the license, whether a human or an AI wrote it.

CRMLS and other California MLSs enforce their own photo and remarks policies on top of state law.

## Federal rules

- **Fair Housing Act:** Describe the property, never the buyer. Avoid words that suggest a preference based on race, color, religion, sex, disability, familial status or national origin — and review AI copy before publishing.
- **Truth in advertising:** AI-written claims about square footage, schools, updates or views must be accurate and backed by records.
- **Texts and automated calls:** AI-powered texting and calling need proper consent. Speed does not replace permission.
- **REALTOR® Code of Ethics:** If you're a REALTOR®, the Code requires a true picture in advertising — including edited and virtually staged photos.
