## Short answer

Yes — Texas agents can use AI for listing copy, photos and marketing. The TREC regulates what is published: accurate ads, brokerage identification, fair housing compliance and disclosure of altered photos.

## Texas advertising rules

- TREC advertising rules require the broker's name to appear in every advertisement, including AI-written MLS remarks, social posts and property pages.
- Sales agents may only advertise under the supervision of their sponsoring broker, so AI-generated campaigns should follow your broker's approval process.
- Misleading statements in ads are prohibited regardless of who, or what, drafted the copy.

Texas MLSs such as HAR (Houston) and NTREIS (Dallas–Fort Worth) each set their own remarks limits and photo rules.

## Federal rules

- **Fair Housing Act:** Describe the property, never the buyer. Avoid words that suggest a preference based on race, color, religion, sex, disability, familial status or national origin — and review AI copy before publishing.
- **Truth in advertising:** AI-written claims about square footage, schools, updates or views must be accurate and backed by records.
- **Texts and automated calls:** AI-powered texting and calling need proper consent. Speed does not replace permission.
- **REALTOR® Code of Ethics:** If you're a REALTOR®, the Code requires a true picture in advertising — including edited and virtually staged photos.

## FAQ

### Can real estate agents use AI to write listings in Texas?

Yes. Texas does not ban AI-written listing copy. The TREC holds the licensee responsible for accuracy, required brokerage identification and fair housing compliance, no matter who drafted the text.

### Do I have to disclose AI virtual staging in Texas?

Label virtually staged or altered photos clearly. Your MLS almost certainly requires it, and undisclosed edits that hide material facts can be treated as misleading advertising by the TREC.

### What must appear in AI-generated real estate ads in Texas?

TREC advertising rules require the broker's name to appear in every advertisement, including AI-written MLS remarks, social posts and property pages. Check the TREC website for the full current rule.

### Is this legal advice?

No. This page is general education, last reviewed 2026-09-25. Rules change — confirm with the TREC, your MLS and your broker.
